富士通フロンテックは、遅くとも令和6年5月以降、当該金型等を用いて製造する本件製品の発注を長期間行わないにもかかわらず、下請事業者に対し、合計2,577個の金型等を自己のために無償で保管させることにより、下請事業者の利益を不当に害していた。

マキタは、資本金の額が3億円以下の法人たる事業者に対し、自社が販売する電動工具の部品等（以下「部品等」という。）の製造を委託している（以下この受託事業者を「下請事業者」という。）。ア マキタは、下請事業者に対して自社が所有する金型を貸与していたところ、遅くとも令和6年1月1日から令和7年9月30日までの間、当該金型を用いて製造する部品等の発注を長期間行わないにもかかわらず、下請事業者に対し、合計3,214型の金型を自己のために無償で保管させることにより、下請事業者の利益を不当に害していた。

スニックは、遅くとも令和6年3月以降、下請事業者に製造を委託した本件製品318製品について、量産が終了し、発注数量が大幅に減少して1個当たりの製造に要する費用が大幅に増加することが明らかであったにもかかわらず、下請事業者と単価の見直しについて協議することなく、一方的に量産時の発注数量を前提とした単価で下請代金の額を定めた（下請事業者10名）。また、金型等を用いて製造する本件製品の発注を長期間行わないにもかかわらず、合計880個の金型等を無償で保管させていた。
