シマノは、資本金の額が３億円以下の法人たる事業者に対し、自社が販売する自転車部品等の製造を委託している。シマノは、下請事業者に対して自社が所有する金型、機械装置及び工具器具を貸与していたところ、令和５年１２月１日以降、当該金型等を用いて製造する本件製品等の発注を長期間行わないにもかかわらず、下請事業者に対し、自己のために無償で、合計４,３１３個の金型等を保管させるとともに当該金型等の現状確認等の棚卸作業を１年間当たり２回行わせていた。
