岩機ダイカスト工業は、下請事業者から製品を受領した後、品質検査をロット単位の抜取りの方法により行っていたが、あらかじめ当該製品に瑕疵があった場合の引取りの条件について下請事業者と合意していないにもかかわらず、受領した合格ロット中の製品に瑕疵があったことを理由として、下請事業者に対し、当該製品を引き取らせていた。さらに、返品に伴う下請代金や加工費を負担させていた。
