ＳＭＫは、下請事業者に対して自社又は自社の顧客が所有する金型又は金型を構成する部品（以下「金型等」という。）を貸与していたところ、遅くとも令和６年１月１日以降、当該金型等を用いて製造する部品の発注を長期間行わないにもかかわらず、下請事業者に対し、合計８２３個の金型等を自己のために無償で保管させることにより、下請事業者の利益を不当に害していた。
