三菱ふそうトラック・バスは、資本金の額が３億円以下の法人たる事業者に対し、自社が販売するトラック及びバスの部品（以下「本件製品」という。）の製造を委託している（以下この受託事業者を「下請事業者」という。）。 イ 三菱ふそうトラック・バスは、下請事業者に対して自社が所有する金型等を貸与していたところ、令和６年３月１日以降、当該金型等を用いて製造する本件製品の発注を長期間行わないにもかかわらず、下請事業者に対し、自己のために無償で、合計５，６９４個の金型等を保管させるとともに当該金型等の現状確認等の棚卸作業を１年間当たり１回行わせることにより、下請事業者の利益を不当に害していた。
