コロナは、資本金の額が３億円以下の法人たる事業者に対し、自社が販売し又は製造を請け負う暖房機器、空調・家電機器及び住宅設備機器若しくはその部品等（以下「本件製品等」という。）の製造を委託している。コロナは、下請事業者に対して自社が所有する金型及び治具（以下「金型等」という。）を貸与していたところ、遅くとも令和５年３月１日以降、当該金型等を用いて製造する本件製品等の発注を長期間行わないにもかかわらず、下請事業者に対し、合計１，８１８個の金型等を自己のために無償で保管させることにより、下請事業者の利益を不当に害していた。
