リョーノーファクトリーは、資本金の額が１０００万円以下の法人たる事業者に対して、自社が製造を請け負う建設機械を構成する部品の製造を委託している。リョーノーファクトリーは、本件下請事業者に対して自社が所有する金型、木型及び治具を貸与していたところ、遅くとも令和５年１０月１日以降、当該金型等を用いて製造する本件部品の発注を長期間行わないにもかかわらず、金型等を無償で保管させていた。
