福岡ダイハツ販売は、個人又は資本金の額が１０００万円以下の法人たる事業者に対し、顧客から請け負う自動車の板金塗装等の修理業務を委託している。遅くとも令和４年８月から令和７年４月まで、自社が請け負う自動車の修理の顧客に代車として貸し出すために、下請事業者に対し、合計７６台の自動車を自己のために無償で提供させることにより、下請事業者の利益を不当に害していた。
