不二サッシは、資本金の額が３億円以下の法人たる事業者に対し、自社が販売し又は製造を請け負うアルミサッシ等の製品を構成する部品の製造を委託している下請事業者に対し、瑕疵がある部品を引き取らせる行為や、瑕疵のない部品と瑕疵のある部品に仕分けさせる行為、金型等を無償で保管させる行為を行った。
