Additionally, on December 5, 2022, the company reported the abolition of permits related to plumbing and fire-fighting construction work, which is also a violation under the Building Business Act. As a result, the Osaka Prefectural Government canceled the company's construction permits, including general construction permits for plumbing and fire-fighting works, on December 21, 2022.

Cause of action

当該建設業者は、令和４年５月19日に提出した建設業法第５条及び第６条に基づく建設業許可申請書類において、同法第７条第１号の規定に基づく経営業務の管理責任者について、当該建設業者の取締役が、株式会社Aでは、取締役の下の統括部長に次ぐ職制上の地位である「工事部長」であって取締役に次ぐ職制上の地位にある者ではなかったため経営業務の管理責任者に準ずる地位にある者ではなく、建設業に関する建設工事の施工に必要とされる資金の調達、技術者・技能者の配置、契約の締結等の経営業務全般にも従事しておらず、しかも、同社がその同人の経験を証明していないにもかかわらず、許可の審査担当者に「工事部長」の地位が取締役に次ぐ職制上の地位にある旨の虚偽の組織図を示すとともに、同人が建設業法施行規則第７条第１号イ（３）に該当する者であり、同人が同社の「工事部長」として同号イ（３）に掲げる経験があることを同社が証明したとの虚偽の記載をし、同年６月10日に同法第３条第１項の許可を受けた。 また、当該建設業者は、令和４年12月５日、管工事業及び消防施設工事業に係る一般建設業の許可を廃止したとの建設業法第12条第５号に該当する旨の同条の規定による届出をした。
