当該建設業者は遅くとも令和６年３月以降に締結した下請契約における請負金額の決定方法について、あらかじめ自らが作成した工種ごとの単価表に基づき決定する運用を行っていたが、契約にあたって書面により締結する必要があるとの認識に至っていなかったことから、法第１９条第１項に規定する法定記載事項を満たした書面による契約締結を行わないまま９，２９１件の建設工事を発注していた事実が認められた。 また、上記の発注において契約締結前に法第２０条第３項前段で定められている法第１９条第１項各号（第２号を除く）の具体的な見積条件の提示がされておらず、同様に法第２０条第３項後段で定められている見積作成に必要な法定期間の設定もされていない事実が認められた。
