鹿島建設株式会社及び同社の社員は、東海旅客鉄道株式会社が発注するリニア中央新幹線（品川駅・名古屋駅間）に係る地下開削工法によるターミナル駅新設工事に関し、その受注に係る取引分野における競争を実質的に制限したとして、令和３年３月１日、私的独占の禁止及び公正取引の確保に関する法律（昭和２２年法律第５４号）違反により、罰金刑の判決を受け、令和８年９月１９日にその刑が確定している。 このことが、建設業法第２８条第１項第２号及び第３号に該当すると認められる。
