株式会社ベストは、三次下請として請け負った東京都町田市におけるとび、土工工事において、令和６年４月１１日、休業４日以上の労働災害が発生したにもかかわらず、遅滞なく、労働者死傷病報告書を所轄労働基準監督署長に提出しなかった。 この件について、遅滞なく法令の定める報告をしなかったとして、同社及び同社の代表取締役は、令和８年３月１９日付けで労働安全衛生法違反により、立川簡易裁判所からそれぞれ罰金刑（２０万円）の略式命令を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
