当該建設業者は、京都府内の民間発注工事において、株式会社エムズコーポレーションから同社が発注者から請け負った建設工事の全部又はその主たる部分を請け負った。当該建設業者と発注者らが連絡の取れなくなるまで、発注者に株式会社エムズコーポレーションの名刺を渡した同社を名乗る当該建設業者の担当者らが工事現場に入り工事を施工し、本件工事の遅延理由などについても、この担当者が発注者に説明していて、株式会社エムズコーポレーションも当該建設業者がその報告を怠っていたためにその状況を十分に把握できない状況が続いた。また、株式会社エムズコーポレーションが配置した監理技術者は、同社の営業所の専任の技術者であり、建設業法第26条第３項の規定に違反していたため、適格な技術者ではなかった。 以上のとおり、当該建設業者は、本件工事において、建設業法第22条第２項の規定に違反して、株式会社エムズコーポレーションから同社が発注者から請け負った建設工事を一括して請け負った。
