Although the amount of the contract consideration (請負代金) under a subcontract contract concluded in order to perform the construction was at least the amount specified by Cabinet Order under Article 3, Paragraph 1, Item 2 of the Construction Business Act, the company did not place a supervising engineer (監理技術者) pursuant to Article 26, Paragraph 2 of the Construction Business Act for that construction. In addition, for the purpose of concealing the need to place a supervising engineer, the company allegedly pretended that the subcontract contract consideration amount was less than the amount specified by Cabinet Order under Article 3, Paragraph 1, Item 2 of the Construction Business Act, and then created a施工体制台帳 (construction implementation structure ledger) and 施工体系図 (construction system diagram) that differed from the facts, and submitted the construction implementation structure ledger to the public works project owner. These matters were recognized as corresponding to Article 28, Paragraph 1, Item 2 of the Construction Business Act (as referenced in the record: 建設業法第28条第3項（第1項第2号該当）).
