森下住設（株）は、大和郡山市内の水道施設工事において、当該建設工事を施工するために締結した下請契約の請負代金の額が建設業法第３条第１項第２号の政令で定める金額以上になるにもかかわらず、当該建設工事に関し、建設業法第２６条第２項の規定に基づく監理技術者を置かなかった。また、監理技術者を置く必要があることを隠匿する目的で、当該建設工事を施工するために締結した下請契約の請負代金の額が建設業法第３条第１項第２号の政令で定める金額に満たないものであると偽った上、事実と異なる施工体制台帳及び施工体系図を作成し、当該施工体制台帳を公共工事の発注者に提出した。これらのことが、建設業法第２８条第１項第２号に該当すると認められる。
