The construction company transferred its headquarters from Hyogo Prefecture to Osaka Prefecture in April 2010, consolidating its Ashiya headquarters and Kobe branch, and established a new Kobe Office with a 'Smile Business Division' to conduct or attempt to conduct construction business requiring permits. Despite this, the company listed in permit application documents that its offices were only within Osaka Prefecture, and received various construction permits in June 2010, June 2015, July 2018, and June 2020 for multiple construction categories. The company also submitted permit applications in May 2020 indicating additional offices in Kobe, Wakayama, and Kyoto, claiming no subordinate offices outside Osaka, and received permits accordingly. The Kobe Office was closed in May 2021, but permit applications in October 2021 again listed offices in Wakayama and Kyoto, claiming no subordinate offices outside Osaka, and received a permit for electrical work in November 2021. The company conducted construction business at offices outside Osaka from June 2020 to December 2021 without holding the necessary permits from the Minister of Land, Infrastructure, Transport and Tourism. Furthermore, as of April 2024, the company submitted notifications under Article 12, Paragraph 5 of the Construction Business Act regarding general and specific construction permits for electrical, piping, building, carpentry, roofing, tile, steel structure, painting, waterproofing, and interior finishing works.

(1) A The construction company, in private projects within Osaka City, violated Article 3, Paragraph 1 of the Construction Business Act by accepting construction work exceeding the amount specified in Enforcement Order Article 1-2 without the necessary permit for electrical work. B The same company, in private projects within Ashiya City, violated the same article by accepting construction work exceeding the specified amount without the necessary permit for telecommunications work. C The same company, in private projects within Wakayama City, violated the same article by accepting construction work exceeding the specified amount without the necessary permit for paving work. (2) The company, during fiscal years 2020 to 2022, violated Article 26, Paragraph 1 of the Construction Business Act by failing to assign qualified chief engineers to multiple construction sites (115 out of 124 sites within Osaka Prefecture and 26 out of 27 sites outside Osaka Prefecture) among the projects it received orders for. (3) During the same period, the company violated Article 22, Paragraph 1 of the Act by not assigning qualified chief engineers to multiple construction sites (37 out of 124 within Osaka Prefecture and all 27 outside Osaka Prefecture), and by effectively outsourcing the contracted construction work to others without substantial involvement in the subcontracted projects, thereby not fulfilling the requirements for proper construction management.
