Cause of action

(1) 当該建設業者は、平成22年４月に兵庫県から大阪府に本部を移転し、兵庫県内の芦屋本部及び神戸支店を統合したうえで新たに開設した「神戸オフィス」に「住まいる事業部」を配置して、許可を受ける建設業に係る営業をし、又はしようとしていたにもかかわらず、建設業法第５条の許可申請書及び同法第６条の書類（以下「許可申請書類」という。）において、営業所が大阪府内以外にはない旨を記載し、同年６月18日に、建築工事業、大工工事業、屋根工事業、電気工事業、管工事業、タイル・れんが・ブロツク工事業、鋼構造物工事業及び内装仕上工事業に係る同法第３条第１項の建設業の許可を受けた。その後、同様に、大阪府外に設けた営業所において、許可を受け、又は受けている建設業に係る営業をし、又はしようとしていたにもかかわらず、許可申請書類において、営業所が大阪府内以外にはない旨を記載し、同年10月１日に塗装工事業及び防水工事業、平成27年６月18日に建築工事業、大工工事業、屋根工事業、電気工事業、管工事業、タイル・れんが・ブロツク工事業、鋼構造物工事業、塗装工事業、防水工事業及び内装仕上工事業、平成30年７月13日に管工事業（同年６月に廃止）に係る同法第３条第１項の建設業の許可を受けた。 また、当該建設業者は、令和２年５月26日に提出した許可申請書類において、大阪府内の主たる営業所のほか、神戸オフィス、和歌山県内の営業所「和歌山営業所」及び京都府内の営業所「京都支店」を設けて管工事業、建築工事業、大工工事業、屋根工事業、タイル・れんが・ブロツク工事業、鋼構造物工事業、塗装工事業、防水工事業又は内装仕上工事業に係る営業をし、又はしようとしているにもかかわらず、大阪府内の主たる営業所のほかに従たる営業所は「該当なし」とするなどの内容を記載し、同年６月18日に、管工事業、建築工事業、大工工事業、屋根工事業、タイル・れんが・ブロツク工事業、鋼構造物工事業、塗装工事業、防水工事業及び内装仕上工事業に係る同法第３条第１項の建設業の許可を受けた。 さらに、当該建設業者は、令和３年５月に神戸オフィスを閉鎖したが、同年10月29日に提出した許可申請書類において、大阪府内の主たる営業所のほか、和歌山営業所及び京都支店を設けて電気工事業、管工事業、建築工事業、大工工事業、屋根工事業、タイル・れんが・ブロツク工事業、鋼構造物工事業、塗装工事業、防水工事業又は内装仕上工事業に係る営業をし、又はしようとしているにもかかわらず、大阪府内の主たる営業所のほかに従たる営業所は「該当なし」とするなどの内容を記載し、同年11月26日に、電気工事業に係る同法第３条第１項の建設業の許可を受けた。 (2) 当該建設業者は、少なくとも許可を受けた令和２年６月18日から令和３年12月24日まで、大阪府内の主たる営業所に加え、大阪府外に設けた(1)に記載の営業所において許可を受けた建設業の営業をしており、国土交通大臣の建設業法第３条第１項の建設業の許可も受けていない。 (3) 当該建設業者は、令和６年４月１日、許可を受けた電気工事業及び管工事業に係る一般建設業並びに建築工事業、大工工事業、屋根工事業、タイル・れんが・ブロツク工事業、鋼構造物工事業、塗装工事業、防水工事業及び内装仕上工事業に係る特定建設業の許可について、建設業法第12条第５号に該当する旨の同条の規定による届出をした。
