有限会社羽野建技は、経営業務の管理責任者であった者が、平成30年5月22日に役員を退任してから、平成31年5月8日までの間、建設業法第7条第1号に規定する要件を満たす者を欠く状況であったにもかかわらず、同法11条第5号に規定されている届出を行わずに営業を継続していた。 このことが、建設業法第7条第1項及び同法第11条第5項に違反し、同法第28条第1項本文に該当すると認められる。
