（株）Ｙ．Ｓは、太宰府市発注の土木工事において、建設業法第３条第１項の土木工事の許可を受けずに建設業を営む（株）みなみと、同法施行令第１条の２第１項で定める軽微な建設工事の範囲を超える土木工事について、下請契約を締結した。 また、（株）Ｙ．Ｓは、令和７年１月頃に営業所を福岡市博多区に移転したが、同法第１１条第１項の規定に違反して、営業所の所在地に係る変更届出を提出しなかった。以上のことは、建設業法第28条第１項本文及び同項第６号に該当する。
