有限会社有澤建設工業は、建設業法第26条第3項及び建設業法施行令第27条により専任の主任技術者等の配置が義務づけられている高知県須崎土木事務所発注の「6災第3号 県道久礼須崎線道路災害復旧工事」に、同法第7条第2号規定の、営業所の専任技術者（現行法では「営業所技術者」と呼称するが、本件は法改正前の事例に当たるため、旧法の呼称である「営業所の専任技術者」を用いる。）を主任技術者として配置していたことが判明した。 このことは、建設業法第26条第3項に違反し、同法第28条第1項第2号に該当すると認められる。
