松蔭技建は、福岡県及び苅田町発注の公共工事において、建設業法第22条第１項の規定に違反して、自らが請け負った建設工事を一括して下請業者に請け負わせた。また、同工事において、事実と異なる下請内容を記載した虚偽の施工体制台帳及び施工体系図を作成した。以上のことは、建設業法第28条第１項第２号及び第４号に該当する。
