笹原セメント工業所の代表者は、令和4年9月28日、福岡県八女郡広川町の工事現場において、労働者に瓦撤去等の作業を行わせるに当たり、屋根の端に囲いを設ける等、労働者が墜落するおそれのある場所に係る危険を防止するための必要な措置を講じなかった。また、上記措置を講じることなく漫然と同人に作業を行わせた過失により、同人が屋根上から地上に墜落し、その後死亡した。このことにより、令和5年2月20日、八女簡易裁判所から、労働安全衛生法違反及び業務上過失致死の罪で、罰金50万円の略式命令を受け、その刑が確定している。このことは、建設業法第28条第1項第3号に該当する。
