株式会社オフィス・ヒロは、令和３年９月１８日、下松市内の一条メガソーラー山口下松発電所建設工事雨水排水工事現場において、労働者に、掘削溝内に立ち入らせて床均し等の作業を行わせるに当たり、あらかじめ土止め支保工を設けるなど危険を防止する措置を講じないまま、労働者を溝内に立入らせた過失により、土砂が崩落し労働者を窒息により死亡させた。 これらにより、労働安全衛生法違反及び刑法２１１条前段に規定する業務上過失致死の罪に当たるものとして、周南簡易裁判所から代表取締役が罰金５０万円の略式命令を受け、令和４年７月２１日に刑が確定した。 このことが、建設業法第２８条第１項第３号に該当するものと認められる。
