On October 11, 2018, during construction work in Meguro-ku, Tokyo, a worker dispatched to Nagakubo Kogyo Co., Ltd. was ascending/descending an iron external staircase to remove waste located on the rooftop. The stair tread came off, and the worker fell approximately 9 meters and died. The company’s director responsible for overall construction management and safety management for the project allowed the worker to use the iron external staircase that had rusted and corroded, and did not establish a safe passageway to the rooftop. The above was found to violate Article 23 of the Industrial Safety and Health Act and Article 540, Paragraph 1 of the Industrial Safety and Health Regulations, and Nagakubo Kogyo Co., Ltd. and its director were fined. This was determined to correspond to Article 28, Paragraph 1, Item 3 of the Construction Business Act. Administrative action (Tokyo): The authority required the company to take measures, including: (1) promptly disseminating information about the incident and the details of the disposition to officers and employees; (2) further improving and strengthening safety management systems at the company and construction sites; (3) complying with relevant laws and regulations concerning securing safety in construction work; and (4) preparing and continuously implementing a plan for education and guidance on safe construction for personnel. The company was required to report in writing by November 30, 2021 the measures taken under the preceding items (including any additional measures taken beyond those items).

平成30年10月11日、東京都目黒区内の工事において、有限会社ナガクボ工業に派遣された労働者が、屋上にある廃棄物の搬出を行うため、鉄製の外部階段を昇降していたところ、同階段の踏み段が外れ、約９メートル下に墜落し、死亡する災害が発生した。同工事における施工管理と安全管理を統括する同社取締役は、さび付いて腐食した鉄製の外部階段を被災者に使用させ、屋上に通じる安全な通路を設けていなかった。 以上のことが、労働安全衛生法第23条及び労働安全衛生規則第540条第１項に違反し、有限会社ナガクボ工業及び同社取締役が罰金刑に処せられた。 このことが、建設業法第28条第１項第３号に該当する。
