On June 11, 2022, at a drainage tunnel construction site in Nishikawa Town, Nishimurayama District, Yamagata Prefecture, a boom lift rolled backward, resulting in the death of one worker. The worker was supposed to stop the engine and apply the brake to prevent the lift from rolling away when leaving the operator's seat, but failed to do so. As a result, the lift rolled backward, causing a safety hazard. The company and one employee were subsequently issued a summary order on November 17, 2022, by the Yamagata Summary Court for violating the Labor Safety and Health Act, each fined 200,000 yen, and their sentences were finalized. This incident is deemed to fall under Article 28, Paragraph 1, Item 3 of the Construction Business Act.

木部建設（株）が一次下請として請け負った山形県西村山郡西川町における排水トンネル工事において、令和４年６月１１日、高所作業車が後方に逸走し、作業員1名が死亡する事故が発生した。 作業員が高所作業車を停車させて運転席から離れる場合、同車の原動機を止め、かつ、停止状態を保持するためのブレーキを確実にかける等の逸走を防止する措置を講じさせなければならないところ、作業員に同車運転席から離れる際にサイドブレーキを確実にかけさせるなどしなかったため、同車を後方に逸走させたことから、機械等による危険を防止するため必要な措置を講じなかったとして、同社及び同社社員１名が令和４年１１月１７日、山形簡易裁判所より労働安全衛生法違反で略式命令（それぞれ罰金２０万円）を受け、その刑が確定している。 このことが建設業法第２８条第１項第３号に該当すると認められる。
