株式会社クラハシの元代表取締役は、岩国市の指名競争入札２件について、岩国市職員から入札秘密事項である工事価格の教示を受けて落札し、それら等の謝礼及び今後も同様の取り計らいを受けたいとの趣旨の下、市職員の当時の内妻の旅行費用を供与した。これにより、山口簡易裁判所から公契約関係競売入札妨害罪（刑法第９６条の６第１項、第６０条）及び贈賄罪（刑法第１９８条）による罰金８０万円の略式命令を受け、刑が確定した。 このことが、建設業法第２８条第１項第３号に該当するものと認められる。
