On July 9, 2021, around 1 a.m., a worker employed by Construct Etsu Corporation fell from a work platform on a high-altitude work vehicle during construction of the Otsu Junction East section of the Shin-Meishin Expressway in Otsu City, Shiga Prefecture. The worker sustained fractures to the proximal left humerus and posterior left tibia, resulting in more than four days of absence from work. The company, through its non-registered president, was required to promptly report this injury to the Otsu Labour Standards Inspection Office at 14-15 Uchidihama, Otsu City, but failed to do so until August 19, 2021. Consequently, the company and its president were each fined 200,000 yen for violating the Labour Safety and Health Act (Law No. 57 of 1972), with the fines confirmed on January 11, 2023.

Cause of action

当該建設業者の社長（ただし、取締役と登記されていない。）として、工事を統括掌理し、官公庁に対する各種報告等の業務を担当する者Aが、同社の業務に関し、令和３年７月９日午前１時頃、滋賀県大津市上田上桐生町から滋賀県大津市上田上牧町にかけて工区が所在する新名神高速道路大津ジャンクション東工事において、同社所属労働者が高所作業車の作業床から転落し、左上腕骨近位端及び左脛骨後果を骨折等の負傷をし、４日以上休業することとなったのであるから、遅滞なく、滋賀県大津市打出浜14番15号に所在する大津労働基準監督署長に対し、労働者死傷病報告を提出しなければならないのに、同年８月19日に至るまで同報告を同署長に提出せず、もって遅滞なく法令の定める報告をしなかった。 このことで、当該建設業者及び同社の社長Aは、労働安全衛生法（昭和47年法律第57号）違反により、それぞれ罰金20万円の刑に処せられ、令和５年１月11日にその刑が確定した。
