株式会社コンノ土木は、令和２年12月21日、秋田県能代市松長布地内の河川改良工事現場において、土止め用の仮設矢板を設置する作業を行うに当たり、仕事の工程に関する計画等を作成せず、土止め用仮設矢板の倒壊を防止すべき業務上の注意義務があるのにこれを怠り、労働災害を防止するための必要な措置を講じずに仮設道路に設置してあった土止め用仮設矢板を倒壊させ、下請けの労働者が倒れた矢板に挟まれ死亡した。 この件について、同社及び同社の従業員は令和３年10月22日付けで労働安全衛生法違反及び業務上過失致死罪により能代簡易裁判所からそれぞれ罰金刑の略式命令を受け、その刑が確定した。 このことが、建設業法第28条第１項第３号に該当すると認められる。
