有限会社恵大の専務取締役である円本和生は、有限会社ノジリの代表取締役である野尻邦彦と共謀の上、虚偽の労働者死傷病報告を労働基準監督署に提出し、事実が記載された労働者死傷病報告を労働基準監督署に提出しなかったことにより、竹田簡易裁判所から労働安全衛生法違反として罰金20万円の略式命令を受け刑が確定した。 このことは、建設業法第28条第1項第3号に該当する。
