冨田電気通信株式会社は、令和５年２月28日を審査基準日とする経営事項審査申請において、令和４年３月30日に建設業法第28条第３項（同項第２号該当）に基づく営業停止処分を受けたにもかかわらず、当該申請に係る申請書の項番58（営業停止処分の有無）について事実と異なる記載をし、当該申請に基づき得られた結果通知書をもって、令和６年度の京都府建設工事競争入札参加資格申請を行い、京都府が当該結果通知書を資格審査に用いた。 このことは建設業法第28条第１項第２号に該当し、同条第１項の規定により指 示処分の対象となる。
