株式会社エスポートは、令和２年11月以降に受注した５件の建設工事において、建設業法第26条第１項の規定に基づき主任技術者を工事現場に配置すべきところ、これに違反して資格要件を満たさない者を配置していた。また、令和５年１月以降に受注した岡山県倉敷市、広島県福山市、千葉県千葉市における４件の建設工事において、神奈川県川崎市に所在する営業所に常勤して専らその職務に従事すべき営業所の専任技術者を主任技術者として配置し、さらに実質的な主任技術者としての職務は、資格要件を満たさない者に行わせていた。 このことは、建設業法第28条第１項第２号に該当する。
