株式会社エイワン不動産建設は、営業所に常勤して専らその職務に従事しなければならない専任技術者を、工事現場ごとに専任の技術者を要する工事の主任技術者として配置し、従事させた。 また、同工事の主任技術者を別工事の主任技術者として重複配置した。 このことは、建設業法第２８条第１項第２号に該当する。 さらに、民間発注の塗装工事及びとび・土工・コンクリート工事において、建設業法第３条第１項の許可を受けていないにも関わらず、同法施行令第１条の２第１項で定める軽微な工事の範囲を超えて請負契約を締結した。 このことは、建設業法第２８条第１項本文に該当する。
