株式会社大和興業の役員は、刑法（傷害罪）違反により罰金20万円の刑が確定した。このことは、建設業法第8条第8号が定める欠格要件に該当するため、建設業法第29条第1項第2号に規定する許可の取消し事由に該当する。さらに、同法人は建設業法第8条第8号に該当するにもかかわらず、令和3年8月25日に西宮土木事務所に提出した建設業許可申請において、様式第6号「誓約書」において欠格要件に該当しないことを誓約し、様式第7号別紙「常勤役員等の略歴書」において賞罰の内容をなしと記載したことにより、不正の手段により許可を受けた。このことは、建設業法第29条第1項第7号に規定する許可の取消し事由に該当する。
