常磐開発(株)元営業第一部部長（以下「元部長」という。)及び同社元双葉営業所所長（以下「元営業所長」という。）は、令和３年７月８日に福島県楢葉町が執行した「Jヴィレッジ駅前交通広場トイレ建築工事」（以下「本件工事」という。）の指名競争入札において、同町の元建設課課長補佐兼建築住宅係長（以下「元課長補佐」という。）と共謀の上、元課長補佐から本件工事の入札の秘密事項である設計金額の教示を受け、もって偽計を用いて、公の入札で契約を締結するためものの公正を害すべき行為をしたものである。 これにより、元部長及び元営業所長は、刑法第６０条及び同法第９６条の６第１項（公契約関係競売等妨害）に該当し、元部長は令和４年７月１２日に懲役１０月（執行猶予３年）の判決を受け、同年７月２７日にその刑が確定し、他方、元営業所長は令和４年６月１５日に懲役１０月（執行猶予３年）の判決を受け、同年６月３０日にその刑が確定した。 このことが、建設業法第２８条第１項第２号に該当すると認められる。
