Between March 1, 2019, and February 28, 2023, the construction company RS engaged in construction projects in Aomori, Yamanashi, Shimane, and Nagano Prefectures where the construction site and the office were not sufficiently close. The company violated Article 7, Item 2 of the Construction Business Act by assigning a dedicated technician as a chief technician under Article 26, Paragraph 1, to the construction site, despite the technician not being able to be considered fully dedicated to the office during certain periods. As a result, the dedicated technician was not consistently present at the office to perform their duties full-time. The Osaka Prefectural Government issued an instruction under Article 28, Paragraph 1 of the Construction Business Act, requiring the company to comply with laws and regulations and to take measures to prevent similar issues in the future.

当該建設業者は、平成31年３月１日から令和５年２月28日までの間に請け負った建設工事のうち、工事現場の職務に従事しながら実質的に営業所の職務にも従事しうる程度には工事現場と営業所が近接していない青森県、山梨県、島根県及び長野県内等の工事において、建設業法第７条第２号の規定に違反して、同号に規定する営業所における専任の技術者を同法第26条第１項に規定する主任技術者として工事現場に配置した。 このことにより、営業所における専任の技術者が、その営業所に常勤して専らその職務に従事すべきところを、一定期間、専任しているとは認めがたい状態にあった。
