A former advisor of Aisawa Kogyo Co., Ltd. was involved in bid rigging and collusion during a public construction tender for the Gifu evaluation facility project on November 20, 2020. He received confidential information, including the investigation standard price, from the then Construction Section Chief of the Defense Ministry's Kinki-Chubu Defense Bureau. He conspired with the former Nagoya branch manager of the company and the former Nagoya branch manager of Senko Corporation, the lead company of the joint venture with Aisawa Kogyo, to use false means to obstruct fair bidding. They violated the Anti-Organized Crime and Bidding Collusion Prevention Law (Act to Prevent Public Contract Collusion) Article 8 and Penal Code Article 96-6, Paragraph 1, and were sentenced to 1 year and 6 months imprisonment (with a 3-year suspended sentence) on November 7, 2022, with the sentence finalized. The conduct is recognized as a violation of the Construction Business Act Article 28, Paragraph 1, Items 2 and 3. The suspension period is from March 8, 2023, to July 5, 2023, for 120 days.

アイサワ工業株式会社(以下「同社」という。）元顧問は、令和２年１１月２０日に防衛省近畿中部防衛局が執行した「岐阜（２）評価施設新設建築その他工事」（以下「本件工事」という。）の一般競争入札において、当時防衛省近畿中部防衛局建築課長から本件工事の秘密事項である調査基準価格と近似した価格の教示を受けた。さらに、同社元名古屋支店長及び錢高組・アイサワ工業建設共同企業体の代表企業である株式会社錢高組の元名古屋支店長とともに共謀し共謀し偽計を用いて、公正な入札を妨害したものである。 これにより、同社元顧問及び元名古屋支店長は、入札談合等関与行為の排除及び防止並びに職員による入札等の公正を害すべき行為の処罰に関する法律（官製談合防止法）第８条違反及び刑法第９６条の６第１項（公契約関係競売等妨害罪）違反に該当し、両者は令和４年１１月７日に懲役１年６ヶ月（執行猶予３年）の判決を受け、その刑が確定した。 このことが建設業法第２８条第1項第２号及び第３号に該当すると認められる。
