有限会社松村は，令和２年７月24日に外国人技能実習生である労働者が，広島市内の新営(建設)工事現場において，型枠解体作業中に落下してきたベニヤ板が左足小指にあたり，４日以上休業することになったにもかかわらず，所轄労働基準監督署長に対し，遅滞なく，労働者死傷病報告書を提出しなかった。 このことにより，同社及び同社の代表取締役は，可部簡易裁判所から労働安全衛生法違反により，それぞれ罰金20万円の略式命令を受け，令和３年９月11日にその刑が確定した。 このことが，建設業法第28条第１項第３号に該当すると認められる。
