The construction business operator contracted the entire construction project, commissioned by a private client in Minato City, Tokyo, to Takumiya Corporation. The operator arranged for secondary subcontractors to perform various specialized construction tasks, including demolition, waterproofing, carpentry, glazing and drywall, stone and tile work, interior finishing, electrical work, plastering, and plumbing, and managed site supervision and coordination among subcontractors. The construction project comprised multiple types of construction work, including scaffolding, earthwork, concrete work, waterproofing, carpentry, interior finishing, stonework, tile and brickwork, electrical, plastering, and plumbing. Takumiya Corporation was responsible for the plumbing work, which constituted a significant portion of the project. To undertake this project, the operator was required to hold either a building construction license or a plumbing construction license. However, the operator engaged in the project without such permits, violating Article 3, Paragraph 1 of the Building Business Act, by contracting construction work exceeding the amount specified in Enforcement Order Article 1-2 without the necessary license. Additionally, the subcontracted amount for the work exceeded 40 million yen (or 60 million yen for comprehensive building work), requiring a specific construction license for building or plumbing work, which the operator did not possess, in violation of Article 16, Item 1 of the Building Business Act and its enforcement regulations. Furthermore, the operator failed to prepare and maintain a construction organization ledger and a construction system diagram as required by Article 24-8, Paragraph 1 and Paragraph 4 of the Building Business Act.
