On October 15, 2022, within the industrial waste intermediate processing facility of Yuenkai Corporation Nishiimoto Sand and Gravel (Ueda Fusu, Tabuse Town, Kumage District, Yamaguchi Prefecture), the company installed a concrete crusher on the tip of a drag shovel, a vehicle-type construction machine, and used it for lifting a metal box, which was outside its primary purpose. This failure to take necessary safety measures led to the drag shovel overturning, causing a worker to be pinned under the metal box and suffer fractures in both legs. The incident was found to violate Articles 119(1), 120(1), 122 of the Labor Safety and Health Act, and Article 164(1) of the Labor Safety and Health Regulations. As a result, the Yamaguchi Prefectural Court issued summary orders imposing a fine of 200,000 yen on both the company and its representative, Kiyokazu Nishimoto, with the penalties confirmed on June 16, 2023.
