On October 15, 2022, within the industrial waste intermediate processing facility of Yuenkai Corporation Nishiimoto Sand and Gravel (Ueda Fusu, Tabuse Town, Kumage District, Yamaguchi Prefecture), the company installed a concrete crusher on the tip of a drag shovel, a vehicle-type construction machine, and used it for lifting a metal box, which was outside its primary purpose. This failure to take necessary safety measures led to the drag shovel overturning, causing a worker to be pinned under the metal box and suffer fractures in both legs. The incident was found to violate Articles 119(1), 120(1), 122 of the Labor Safety and Health Act, and Article 164(1) of the Labor Safety and Health Regulations. As a result, the Yamaguchi Prefectural Court issued summary orders imposing a fine of 200,000 yen on both the company and its representative, Kiyokazu Nishimoto, with the penalties confirmed on June 16, 2023.

Cause of action

令和４年１０月１５日、有限会社西本砂利の産業廃棄物中間処理施設内（熊毛郡田布施町大字上田布施）において、車両系建設機械であるドラグ・ショベルのアームの先端部分にコンクリート圧砕機を設置して金属製の箱の吊り上げ作業に使用してドラグ・ショベルをその主たる用途以外の用途に使用し、もって機械等による危険を防止するため必要な措置を講じなかった。 その結果、ドラグ・ショベルが転倒し、労働者１名が金属製の箱の下敷きとなり、両脚を骨折する労働災害が発生し、労働安全衛生法第１１９条第１号、第２０条第１号、第１２２条及び労働安全衛生規則第１６４条第１項に違反するとして、柳井簡易裁判所から有限会社西本砂利及び代表取締役西本清和の両名がそれぞれ罰金２０万円の略式命令を受け、令和５年６月１６日に刑が確定している。
