Chokai Corporation (hereafter 'the company') was involved in a bid rigging incident concerning the 'Gifu (2) Evaluation Facility New Construction and Other Works' project ordered by the Kinki Central Defense Bureau (hereafter 'the bureau'). The company's former Nagoya branch manager obtained a price close to the investigation standard price from bureau staff in advance, which obstructed fair bidding. On November 7, 2022, the company’s former branch manager was convicted under Article 96-6, Paragraph 1 of the Penal Code (obstruction of public contract-related auctions), and Article 8 of the Anti-Commercial Bid-Rigging Law (Act on Prevention of Unfair Competition), receiving a sentence of 1 year and 6 months imprisonment, with a 3-year probation, which was finalized. This conduct is recognized as falling under Article 28, Paragraph 1, Items 2 and 3 of the Construction Business Act. As a result, the Kinki Regional Development Bureau issued a business suspension order for 120 days from March 8, 2023, to July 5, 2023, restricting the company's construction business activities related to public works within Osaka, Shizuoka, Aichi, and Mie prefectures. The suspension applies to construction businesses engaged in general building work, including civil engineering, electrical, plumbing, and other specified types, as detailed in the official order.
