The construction contractor was a first-tier subcontractor for a government-ordered project in Osaka City undertaken by Company A. Although the contractor subcontracted the work to an individual sole proprietor, Mr. B, engaged in construction business, they failed to notify the prime contractor, Company A, who directly contracted the work from the client, of the subcontracting arrangement, in violation of Article 24-8, Paragraph 2 of the Construction Business Act.

The construction company violated Article 26, Paragraph 1 of the Building Industry Act by assigning technicians employed by Kabushiki Kaisha Soshutsu as chief engineers at construction sites, despite lacking a direct and continuous employment relationship. Additionally, the company violated Article 22, Paragraph 1 of the same Act by having Kabushiki Kaisha Soshutsu undertake the contracted construction work as a single entity.

The construction company was found to have failed to meet the standards specified in Article 7, Item 2, sub-items i, ro, or ha of the Construction Business Act because the persons listed as applicants for the construction license were employed by other companies and the company did not have designated personnel at the business office as required. Additionally, the company submitted false information in the license application and in documents required under Article 6, Paragraph 1 of the Act, and obtained a renewal of the license under Article 3, Paragraph 3 of the Act.
