The two clients sold the stocks after distribution, realizing profits of at least 2.39 million yen for Client A and 3.06 million yen for Client B. 顧客のため忠実に投資助言業務が行っていない状況 (1) 特定の顧客に対し、単発スポット銘柄の配信前に銘柄情報を伝達し、売買等の助言を行う行為等 当社は、原則週１回、上場株式１銘柄の買付けを推奨する投資助言を行っており、所定の日時に銘柄名や買付推奨価格等をメール又は自社ウェブサイトにおいて配信（その際配信される銘柄を以下「単発スポット銘柄」という。）している。 こうした中、当社における投資助言業務統括者である甲部長は、令和４年５月から同５年３月までの間に配信した単発スポット銘柄55銘柄のうち、顧客Ａに対しては少なくとも６銘柄について、顧客Ｂに対しては少なくとも16銘柄について、以下の流れで不適切な行為を行っている事実が認められた。 ⅰ．甲部長は、単発スポット銘柄の配信を行う約１週間前に、社内での検討を踏まえつつ投資助言を行う１銘柄を決定する。 ⅱ．単発スポット銘柄が決定すると、当該銘柄の配信前に、顧客２名に対し、スマートフォンのメッセージアプリ等において当該銘柄の買付けを助言する。 ⅲ．単発スポット銘柄の配信日（寄付き前）に、顧客２名に対し、ⅱ．と同様の方法により、当社が配信する買付推奨価格の上限付近の価格等を指値とする売付けを助言する。 ⅳ．単発スポット銘柄の株価が売り指値まで上昇しない場合は、指値を下値に訂正するなど、早く売り抜けるよう助言する。 ⅴ．一連の助言を受けた顧客２名は、事前に買い付けた単発スポット銘柄を配信日（寄付き後）に売り抜け、顧客Ａは少なくとも239万円、顧客Ｂは少なくとも306万円の利益を得ている。 また、甲部長は、上記行為に加え、令和４年９月から同５年３月までの間、一部の顧客に対し、単発スポット銘柄の配信前に、銘柄名は伝達しないものの、どの程度の価格の銘柄かなどを伝達し、配信直後に銘柄名を伝達したらすぐに発注できるよう、準備を依頼したうえで、配信直後に当該銘柄名や成行注文による買付けなどを助言していた。
