Cause of action

１ Aは、平成27年８月28日時点では、建築士事務所の建築士法（平成25年法律第202号）第24条第２項に規定する管理建築士であり、当該建設業者に雇用されていなかった。また、同人は当該建設業者の営業所にほとんど立ち入ることができないなど、当該建設業者の営業所に常勤して専ら職務に従事することもできなかった。また、当該建設業者から給与も受領しておらず、給与の額が最低賃金法（昭和34年法律第137号）に基づく大阪府の地域別最低賃金以上となりえる者でもなかった。 ２ 当該建設業者は、平成27年8月28日に提出した建設業法第17条において準用する同法第５条の許可申請書及び同法第６条第１項の書類に、１のとおり、Aが専任の者ではなく、営業所に置いている者でもなかったにもかかわらず、同人を同法第15条第２号に規定する専任の技術者として当該建設業者の営業所に置いているとの虚偽の内容を記載し、同年９月２5日に建築工事業、大工工事業、屋根工事業、タイル・れんが・ブロツク工事業、鋼構造物工事業及び内装仕上工業業に係る同法第３条第１項の特定建設業の許可を受けた。 ３ 当該建設業者は、Bの一級建築士免許証の写しを同人から受け取り、その写しを添付して、平成28年２月24日に、建設業法第17条において準用する同法第11条第１項及び第４項の規定に基づき、同日にAに代えBを同法第15条第２号に規定する専任の技術者として当該建設業者の営業所に置いたとする変更届を提出したものの、同人は、他の建設業者に雇用され、工事現場の現場代理人などの業務に従事しており、令和元年７月19日からは、建築士事務所の建築士法第24条第２項に規定する管理建築士でもあった。また、同人は当該建設業者の営業所にほとんど立ち入らないなど、当該建設業者の営業所に常勤して専ら職務に従事することもなかった。また、当該建設業者から給与も受領しておらず、給与の額が最低賃金法に基づく大阪府の地域別最低賃金以上となりえる者でもなかった。 ４ 当該建設業者は、令和２年8月26日に提出した建設業法第17条において準用する同法第５条の許可申請書及び同法第６条第１項の書類に、３のとおり、Bが専任の者ではなく、営業所に置いている者でもなかったにもかかわらず、同人が当該建設業者の営業所に置いている同法第15条第２号に規定する専任の技術者であるとの虚偽の内容を記載し、同年９月25日に建築工事業、大工工事業、屋根工事業、タイル・れんが・ブロツク工事業、鋼構造物工事業及び内装仕上工業業に係る同法第３条第３項の特定建設業の許可の更新を受けた。 ５ 当該建設業者は、Cの一級建築士免許証の写しを同人から受け取り、その写しを添付して、令和３年10月11日に、建設業法第17条において準用する同法第11条第１項及び第４項の規定に基づき、同月９日にBに代えCを同法第15条第２号に規定する専任の技術者として当該建設業者の営業所に置いたとする変更届を提出したものの、同人は、同年11月15日まで、建築士事務所の建築士法第24条第２項に規定する管理建築士であり、当該建設業者に雇用されていなかった。その後は、他の建設業者に雇用されて同法第15条第２号に規定する専任の技術者となった。また、同人は、当該建設業者の営業所に一度も立ち入らないなど、当該建設業者の営業所に常勤して専ら職務に従事することもなかった。令和３年10月9日以降当該建設業者から給与も受領しておらず、給与の額が最低賃金法に基づく大阪府の地域別最低賃金以上となりえる者でもなかった。 ６ １、３及び５のとおり、当該建設業者は、建設業法第15条第２号に掲げる許可の基準を満たしていなかった。
