当該建設業者の代表取締役は、当該建設業者の業務を統括し、官公庁に対する各種届出及び報告等の業務を担当するものであるが、同人は、当該建設業者の業務に関し、令和２年９月16日、当該建設業者の倉庫内において、労働者が型枠部材への注油作業に従事中、右踵骨骨折の負傷をし、４日以上休業することになったのであるから、所轄の茨木市上中条二丁目５番７号所在の茨木労働基準監督署長に対し、遅滞なく、労働者死傷病報告書を提出しなければならないのに、令和４年６月22日に至るまで同報告書を提出せず、もって法令の定める報告をしなかった。 このことで、当該建設業者及びその代表取締役は、労働安全衛生法（昭和47年法律第57号）違反により、それぞれ罰金20万円の刑に処せられ、令和５年１月26日にその刑が確定した。
