株式会社早川組の代表取締役は、同社の業務に関し、令和3年4月26日、津島労働基準監督署において、同署長に対し、真実は、同社の労働者が、同年2月19日、同社が請け負った名古屋市中川区高畑2丁目地内における歩道舗装工事の工事現場において、トラックの荷台上のアスファルトをバックホーのバケットに移動させる作業中、同バックホーの運転手である同社の労働者が操作を誤ったことにより、左膝等にバックホーのバケットが衝突して左膝外傷性関節炎等の傷害を負い、4日以上休業したのに、同人が、同月19日、愛知県弥富市内の同社の資材置場において、前記傷害を負った旨の虚偽の内容を記載した労働者死傷病報告書を、情を知らない同社取締役らを介して、郵送により提出し、もって津島労働基準監督署長に虚偽の報告をしたものである。 このことが、労働安全衛生法に違反し、津島簡易裁判所より、法人及び代表取締役が罰金10万円の略式命令を受け、その刑が確定した。 これは、建設業法第28条第1項第3号に該当する。
