当該建設業者の従業員Ａは、当該建設業者の業務に関し、令和３年８月12日、奈良県内の民間工事において、労働者に一則足場以外の足場を使用させるにあたり、当該足場上は高さ10.8メートルの作業場所であり、当該足場には作業床を設けなければならないにもかかわらず、これを設けなかった。 このことで、従業員Ａは、労働安全衛生法（昭和47年法律第57号）違反により、罰金20万円の刑に処せられ、令和４年８月30日にその刑が確定し、当該建設業者は、罰金20万円の刑に処せられ、同日にその刑が確定した。
