株式会社岩村組の元取締役と元顧問が、新発田地域振興局農村整備部発注の「松浦地区区画整理第33次工事」、及び「平木田柳原地区取水工第１次工事」に係る官製談合事件において、当該工事の予定価格の教示を受け、偽計を用いて公の入札で契約を締結するためのものの公正を害すべき行為をしたことにより、令和５年９月20日に公契約関係競売等妨害の容疑で逮捕された。 その後、元取締役は同年10月11日に罰金刑の略式命令に処され、同月26日にその刑が確定している。また、元顧問は令和６年１月29日に懲役１年６カ月（執行猶予３年）の刑に処され、同年２月14日にその刑が確定している。 このことが、建設業法第28条第１項第３号に該当する。
