１ 当該建設業者は、令和３年３月19日及び同年９月１日に提出した建設業法第５条の許可申請書及び第６条第１項の書類において、同社の取締役であるA氏は真の100%株主ではなく、銀行等外部との交渉に資するために同氏が対外的に株主として振る舞うこととし、実際は元取締役のB氏が真の100%株主であるにもかかわらず、A氏が100%株主であってB氏は役員等に含まれないとの虚偽の内容を記載し、令和３年４月14日に建築工事業及び内装仕上工事業に係る建設業の許可を、同年10月１日に熱絶縁工事業に係る建設業の許可を受けた。 ２ 当該建設業者は、建設業法第７条第１号及び建設業法施行規則第７条第１号の規定に基づく経営業務の管理責任者及び同法第７条第２号に規定する同社の専任技術者であるA氏が、同社を遅くとも令和６年７月30日までには取締役を辞任し、若しくは解任され、同年４月には社会保険資格を喪失して、退職後他社に勤務するなど、同社の常勤の役員として職務に従事しておらず、また、同社の営業所に常勤して専ら職務に従事しておらず、同条第１号及び第２号に掲げる許可の基準を満たさなくなった。 ３ 当該建設業者は、建設業法第７条第２号に規定する同社の専任技術者であるC氏が同社を退職し、令和６年６月には他社に勤務するなど、同社の営業所に常勤して専ら職務に従事しておらず、同号に掲げる許可の基準を満たさなくなった。
